1. General provisions
1.1. This document sets out the terms and conditions for using the London Spot website.
1.2. This document is a mutually binding agreement made between the User and London Spot LLC (ID code 406403681, registered address: Tbilisi, Isani district, Saingilo St., N110).
1.3. In these terms and conditions, in the privacy policy and in every other guide or instruction, London Spot LLC is hereinafter referred to as “London Spot” or “we”.
1.4. The terms and conditions for using the London Spot website, together with any changes made to them and London Spot's other regulations, form a single document and must be treated as one agreement made with the User.
1.5. By registering on the website and/or purchasing products, the User accepts these terms and conditions, the privacy policy and the returns and exchange rules, and agrees that they are legally binding.
1.6. If the User does not agree with the content of London Spot's legal documents, they may choose not to use the website. London Spot also asks the User to send any comments by email.
2. Definitions
Terms used in these terms and conditions have the following meanings:
- London Spot / the Company: London Spot LLC (ID code 406403681), established under the laws of Georgia.
- User: a legal entity, or an individual of legal age (18 or over, with legal capacity), who uses the website and/or purchases products listed on it.
- Outlet product: goods listed on the website that may have a minor visual and/or technical flaw or damaged packaging, or that are offered at a special discount, as stated in advance in the product description.
- User's consent: the will expressed to review this document and to the processing of personal data.
- Direct marketing: offering goods or services by post, phone call, email or other telecommunications means.
- Account: the personal page the User registers on the website.
3. Opening an account and registration
3.1. To buy products on the website, registration and/or sign in is required, for which the User provides the following details:
- First and last name
- Actual address
- Contact phone number
- Email address
- Password
3.2. The User confirms and warrants that:
- the information they provide is complete, true and correct;
- they are 18 or over, an adult with legal capacity;
- they will not use another person's identifying data;
- they will not use a name that may be demeaning or offensive;
- they will respect copyright and intellectual property rights, and will not make unauthorised use of London Spot's logo, images, text, graphics or other intellectual property without London Spot's prior written consent;
- they will not take any action that threatens the proper functioning of the website.
4. Placing an order and terms of sale
4.1. Each order placed by the User is a separate contract of sale, to which the User and London Spot LLC are parties.
4.2. Before paying, the User must check the address and contact details they have given. If the address given is incorrect or incomplete, the User is responsible for any resulting delay in delivery.
4.3. Ownership of the purchased item passes to the User once the price of the product has been paid in full.
4.4. London Spot reserves the right to refuse or cancel an order where there is a suspicion of fraud, or of an unauthorised or unlawful transaction.
5. Outlet and faulty or damaged products
5.1. Some of the products listed on the London Spot website fall under the Outlet category, which may have a minor visual or technical flaw or damage (for example, damaged or opened packaging, a small scratch, a visual defect and so on).
5.2. Each such product carries a note on the website, with a detailed description and/or photograph that clearly explains the flaw or damage.
5.3. By placing an order and buying the product, the User confirms that they are fully informed of the item's existing flaw or damage and accept it.
5.4. Under the laws of Georgia in force, the User is not entitled to demand repair, replacement, a refund or a price reduction on the basis of a flaw or damage that they were told about before the purchase, in the product's description or photo on the website.
5.5. The warranty terms do not cover flaws in the product that were stated in the product description at the time of purchase.
6. Delivery terms and checking the product
6.1. Purchased products are delivered by London Spot or by a courier service it engages.
6.2. For the purpose of providing courier services, London Spot is entitled to pass the data needed for delivery to a third party (the courier company): the User's first name, last name, address and phone number.
6.3. Within Tbilisi, delivery takes 3-5 working days. The courier fee within Tbilisi is 5 GEL (unless the website states otherwise for a specific promotion).
6.4. Checking the product on delivery: as soon as the User receives the item from the courier, they must check the product's visual condition on the spot and compare it with the description given on the website.
6.5. If the item turns out to have damage that was not stated in the product description on the website, the User must immediately (in the courier's presence) draw up the relevant report, or notify London Spot's support team of it.
6.6. After the item has been handed over by the courier (confirmed as received), London Spot will not accept claims for obvious visual damage to the item that was not recorded at the time of handover.
7. Payment
7.1. Payment is made only by non-cash means, by bank card.
7.2. When placing an order, the User is redirected to the partner bank's secure page. London Spot does not have access to the User's bank card details.
7.3. Once payment is successfully completed, the User will receive confirmation that the order has been received, at the email address they gave.
8. Returns and exchange policy
8.1. The detailed terms for exchanging and returning purchased products are governed by the law in force and by the returns policy published on the website.
8.2. For a distance purchase, the User (as an individual) has the right to withdraw from the contract within the 14 calendar days set by law, except for the exceptions provided for by law and the cases of pre-agreed flaws set out in Article 5 of this document.
8.3. When returning a product, the item must be presented in its original condition (taking into account any flaw that was stated before purchase).
9. Direct marketing
9.1. The User has the right, on registering or at any time, to consent to or decline receiving advertising or marketing messages.
9.2. The User can opt out of marketing messages at any time, by sending us a message to that effect by email, or by using the Unsubscribe link given in the email.
10. Limitation of liability
10.1. London Spot puts in place appropriate protective measures, but is not liable for damage caused by unauthorised access by third parties.
10.2. London Spot does not guarantee that the website will operate without interruption or that it will be entirely free of technical faults or viruses.
10.3. London Spot is not liable for damage caused by the User sharing their login details with third parties.
10.4. Where a court establishes the Company's liability, it is limited to the value of the disputed product, within the bounds of the law in force.
11. Force majeure
11.1. The parties are released from liability for the partial or complete non-performance of their obligations if this is caused by circumstances of insurmountable force (force majeure).
11.2. Force majeure includes: natural disasters, fire, acts of war, a state of emergency, decisions of state authorities, disruption of the global internet network, and other circumstances beyond the parties' control.
12. Governing law and dispute resolution
12.1. These terms and conditions are governed by, and are to be interpreted in accordance with, the laws of Georgia in force.
12.2. Any dispute between the parties is settled by negotiation. If no agreement is reached, the dispute is heard by the Tbilisi City Court.
12.3. If any clause of this document is held invalid, this does not invalidate the agreement as a whole or its other clauses.
13. Changes and additions
13.1. London Spot reserves the right to unilaterally make changes and/or additions to this document by publishing them on this website.
13.2. If the User continues to use the website after changes are published, this is treated as acceptance of the new terms.
